What is the AFCS?
The AFCS compensates for injuries and illnesses caused or worsened by military service on or after April 6, 2005. Unlike civil claims, the scheme operates on a no-fault basis, meaning you do not need to prove negligence or liability to receive compensation. This makes the AFCS an accessible and valuable source of support for those impacted by the unique demands of military life.
Who is Eligible for the AFCS?
The AFCS is available to:
- Serving members of the Armed Forces.
- Reservists who suffer injuries or illnesses during training or active duty.
- Veterans who develop service-related conditions after leaving the military.
Eligibility covers a wide range of situations, including injuries sustained during combat, training exercises, or exposure to hazardous conditions. Psychological conditions such as post-traumatic stress disorder (PTSD) are also included, provided they are linked to military service.
What Does the AFCS Cover?
The scheme provides compensation for:
- Physical Injuries: Such as fractures, burns, amputations, and other long-term disabilities.
- Mental Health Conditions: Including PTSD, depression, and anxiety caused by traumatic experiences in service.
- Illnesses: Conditions like hearing loss, respiratory issues, or exposure-related illnesses (e.g., asbestos exposure).
- Death Benefits: Payments to dependents in the unfortunate event of a service member’s death.
Compensation is awarded based on the severity of the injury or illness, categorized into tariffs ranging from minor conditions to life-altering injuries. Awards can include lump sum payments and, in more severe cases, ongoing Guaranteed Income Payments (GIPs).
How to Make an AFCS Claim
Making a claim under the AFCS involves a straightforward process:
- Submit a Claim Form: Obtain and complete the AFCS claim form, available online or through your chain of command.
- Provide Supporting Evidence: Include medical records, incident reports, and any other relevant documentation to support your claim.
- Assessment and Decision: Your claim will be assessed by the Ministry of Defence, who will determine eligibility and calculate the compensation award.
Claims should be made within seven years of the injury, illness, or diagnosis. Exceptions may apply for delayed-onset conditions.
