For most people, pneumonia is a word they associate with cold weather, a bad flu, or an occasional story on the news. However, for some members of the British Armed Forces, it has been something far more serious, a life-threatening illness which could have been prevented.

It is a very serious staphylococcus bacterial infection which is often contracted in environments that should have been safe, shared barracks, temporary accommodation, or remote operational bases. It is an illness which not only impacts health, but raises questions about the conditions in which some of our Armed Forces are expected to live.
What Is PVL Pneumonia and Why Does It Affect Soldiers?
PVL pneumonia is caused by a toxin known as Panton-Valentine leukocidin (PVL), which is sometimes produced by Staphylococcus aureus bacteria. It’s rare in the general population, but military personnel may be especially vulnerable.
Why? Because PVL thrives in the kinds of environments no one wants to live in: damp, overcrowded spaces with poor ventilation and inadequate hygiene. Unfortunately, those conditions are not uncommon on bases, particularly in older accommodation or during field training exercises.
In some of the cases we have seen, personnel reported symptoms early but were not given proper medical attention. Others had no idea they were at risk until it was too late. You Served; You Have Rights
Military service comes with risk. That is understood. However, no one should be made ill by their own accommodation and unclean premises. If you or someone you love has suffered from PVL pneumonia and you believe that poor living conditions played a part, you may be entitled to claim compensation.
There are two main routes:
- The Armed Forces Compensation Scheme (AFCS) This is a government scheme providing tax-free lump sums and ongoing support (through Guaranteed Income Payments) for injuries or illnesses caused by service on or after 6 April 2005.
- A Civil Claim Against the Ministry of Defence If it can be shown that the MOD failed in its duty of care, by neglecting hygiene and/or ignoring medical needs, then a civil claim for negligence may be possible.
