At Ison Harrison Solicitors we understand that taking the first step towards seeking help can feel overwhelming. Here are some frequently asked questions about military sexual assault claims, confidentiality, and the support we offer.
-
Can I make a claim for sexual assault and/or harassment which happened during my service in the Armed Forces?
Yes. If you experienced sexual assault and/or harassment during your time in the British Armed Forces whether during training, deployment, or on base, you may be entitled to pursue a compensation claim. You do not have to wait until you leave service, and you do not need to have reported the incident to the military or civilian police before seeking legal advice.
-
What can a military sexual assault claim cover?
A claim can cover a wide range of losses and injuries, including:
- Psychological conditions such as post traumatic stress disorder, depression, and anxiety
- Physical injuries arising from the assault
- Loss of earnings, fringe benefits and pension if you are unable to return to work
- Costs of therapy, counselling, and rehabilitation
- Out-of-pocket expenses connected to your recovery
Every case is assessed individually to ensure full and fair compensation.
-
Will my enquiry be kept confidential?
Absolutely. At Ison Harrison Solicitors confidentiality is a cornerstone of our service. We will not contact your employer, chain of command, or anyone else without your permission. You are in full control of what happens with your information.
-
Do I have to report the assault through the military system before I can claim?
No. You are not required to report the incident through the Service Justice System in order to pursue a claim. You have the right to seek independent legal advice and support outside of the military chain of command. However, it is important that the incident(s) are reported if a claim is to be made as this will form part of the evidence.
-
I’m currently posted overseas. Can I still access support?
Yes. Wherever you are based, in the UK or overseas, we can provide legal advice and support. We are experienced in assisting serving personnel and veterans stationed around the world.
-
I’m worried about the cost. Do you offer No Win, No Fee?
Yes. Our military sexual assault and harassment claims are handled on a No Win, No Fee basis. This means you will not pay any legal fees unless your claim is successful, helping to remove financial risk.
-
What if my mental health has been affected?
You can claim compensation for psychological injuries such as PTSD, depression, and anxiety. We will work closely with you and medical professionals to assess the full impact on your mental health and ensure it is properly reflected in your claim.
-
What if I don’t want to make a claim but still want support?
That’s absolutely fine. We work with you based on what you want to do. There is no pressure. We can also signpost you to independent support services such as SaluteHerUK or Op Courage, who offer confidential advocacy for Armed Forces personnel and veterans who have experienced sexual violence.
-
What are the time limits for making a military sexual assault claim?
Generally, personal injury claims must be brought within three years of the date of the incident (or from when you first realised you had been injured). However, given the sensitive nature of sexual assault cases and service life complexities, there may be grounds to extend these time limits. We recommend seeking advice as soon as possible.
